Welcome to KIMAKSHI. These Terms & Conditions govern your access to and use of our website, including browsing, purchasing, and enjoying our boutique designer apparel.

By accessing our website or placing an order, you agree to these Terms & Conditions. Please read them carefully before making a purchase.

1. Product Descriptions & Sizing

At KIMAKSHI, we strive to provide accurate product descriptions, images, and sizing information for all our garments.

Our garments may feature premium fabrics, including cotton, linen, silk blends, and other materials.
Due to differences in screen brightness, display settings, lighting, photography, and handcrafted or hand-dyeing processes, slight variations in colour, shade, texture, or thread patterns may occur.
Such minor variations are considered normal and may not constitute a product defect.
Our sizing is based on the measurements provided in the product-specific size charts. Customers are requested to review the size chart carefully before placing an order.
Fit may vary depending on fabric, garment design, and individual body measurements.

2. Pricing & Promotions

All product prices displayed on the KIMAKSHI website are in Indian Rupees (INR) and include applicable GST, where required under Indian law.

Shipping charges, if applicable, will be displayed during checkout or communicated before order confirmation.
Promotional offers, discount codes, sale prices, and campaign benefits are subject to the specific terms and validity periods communicated with each offer.
KIMAKSHI reserves the right to modify, suspend, or discontinue promotional campaigns, discount coupons, sale offers, and clearance stock availability, subject to applicable law.
Changes to promotions will not affect orders that have already been confirmed, except where correction or cancellation is permitted under applicable law or these Terms.
Discount codes cannot be combined unless explicitly stated in the relevant offer.

In the event of a pricing or technical error, we reserve the right to contact the customer to confirm the correct price or cancel the affected order and issue a refund for any amount paid, as applicable under law.

3. Orders & Payment

All orders placed on our website are subject to acceptance and availability.

Customers must provide accurate and complete information when placing an order.
Orders may be subject to verification before dispatch, particularly for Cash on Delivery (COD) purchases.
We reserve the right to cancel or refuse an order in cases of suspected fraud, incorrect pricing, product unavailability, or other legitimate reasons, subject to applicable law.
For prepaid orders that are cancelled by KIMAKSHI, any amount collected will be refunded in accordance with applicable refund procedures.
Customers are responsible for ensuring that their selected products, sizes, shipping details, and contact information are correct before completing checkout.

4. Exchange Policy – 3 Days Only (No Returns)

KIMAKSHI follows a 3-day exchange-only policy. We do not accept returns for a refund or store credit for reasons such as change of mind, incorrect size selection, or personal preference, except where required by applicable law or where otherwise expressly agreed by KIMAKSHI.

Exchange Request Period:

Exchange requests must be raised within 3 days of delivery of the product.
Requests submitted after the 3-day period may not be accepted, except where required by applicable law.
Products must be unused, unworn, unwashed, and returned in their original condition with all tags, labels, and packaging intact.
Products showing signs of use, damage caused by the customer, alteration, washing, or missing tags may not qualify for exchange.
All exchange requests are subject to product inspection and availability of the requested replacement.

First Exchange – Free

Your first eligible exchange is covered by KIMAKSHI at no additional exchange logistics charge. The first exchange shipping fee will be ₹0, subject to the eligibility conditions mentioned above.

Subsequent Exchanges – ₹100

For subsequent eligible exchanges, a flat logistics charge of ₹100 will apply. Where applicable, this charge will be deducted from the customer's available wallet balance or collected through an approved payment method before the exchange is processed.

Incorrect Product or Size Delivered

If KIMAKSHI delivers an incorrect product or a size different from the one confirmed in the order, the customer will not be charged any exchange or shipping logistics fees for correcting the error.

Customers should contact our support team within the exchange request period and provide the order number and relevant product details. Supporting photographs or videos may be requested to help verify the issue.

Nothing in this policy limits any consumer rights or remedies available under applicable Indian law.

5. Shipping & Delivery

KIMAKSHI works with third-party logistics and courier partners to deliver orders to customers.

Estimated delivery timelines are provided for guidance and may vary depending on the delivery location, courier operations, weather conditions, public holidays, or other circumstances beyond our control.
Customers must provide a complete and accurate shipping address and an active phone number for delivery coordination and COD verification.
Customers are responsible for being available to receive their shipments and providing reasonable assistance to the courier partner where required.
Delays caused by courier partners or circumstances beyond our reasonable control will be communicated where information is available.

Where available, shipments may be processed using DTDC Express or other logistics partners. Open Box Delivery, inspection, and shipment verification are subject to the services and procedures offered by the relevant courier partner for the particular shipment.

6. Customer Responsibilities & Order Verification

Customers are expected to provide accurate information and cooperate with reasonable order verification and delivery procedures.

Customers must provide a valid name, shipping address, phone number, and other details necessary for order processing.
COD orders may require phone or other verification before dispatch.
Customers must not misuse promotional codes, provide knowingly false information, or submit fraudulent claims.
Customers must not engage in abusive, fraudulent, or unlawful conduct in connection with purchases, exchanges, or customer support.

Where an order is reasonably suspected of involving fraud, misuse, or inaccurate information, KIMAKSHI may conduct verification, suspend processing, or cancel the order, subject to applicable law.

Any restriction on future orders or website access will be proportionate to the circumstances and subject to applicable law.

7. Product Inspection & Disputes

Products submitted for exchange may be physically inspected by KIMAKSHI or its authorized logistics partners to verify their condition and eligibility under the exchange policy.

Where DTDC Express Open Box Delivery is available and applicable to a shipment, customers should follow the courier's instructions for inspecting the package and reporting any visible discrepancies or transit damage.

Customers are encouraged to retain order confirmations, invoices, shipment details, and relevant photographs or videos to help resolve any concerns regarding an order.

Any inspection or verification procedure is intended to assist in resolving disputes and does not remove or limit any rights available to customers under applicable consumer protection laws.

8. Intellectual Property

All content on the KIMAKSHI website, including product photographs, designs, logos, text, graphics, and branding, is owned by or licensed to KIMAKSHI, unless otherwise stated.

No website content may be copied, reproduced, distributed, modified, or used for commercial purposes without prior written permission, except as permitted under applicable law.

9. Limitation of Liability

To the extent permitted by applicable law, KIMAKSHI shall not be liable for indirect or consequential losses arising from the use of our website, delays caused by third-party service providers, or circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable Indian law, including statutory consumer rights and remedies.

10. Privacy & Personal Information

Your use of our website is also governed by our Privacy Policy, which explains how we collect, use, process, and protect your personal information.

11. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of India.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the competent courts in India, subject to applicable law and the rights of consumers to seek remedies before any other competent forum or authority as permitted by law.

12. Changes to These Terms

KIMAKSHI reserves the right to update or modify these Terms & Conditions from time to time to reflect changes in our business practices, services, policies, or applicable laws.

Any changes will be published on this page with the revised effective date. Customers are encouraged to review these Terms periodically.
